ToS #9 question

I have a question regarding ToS #9:

It says that the audio clip has to be 30 seconds or shorter in-order to upload it due to fair use. My question is, what if the song in question is under 30 seconds in length? Where does that exactly fall in the rules? Are you allowed to upload the full song or what?

So to summarize: if the (copyrighted) song is <30 seconds then posting the entire song is NOT legal.
