This one should be a concern for everyone thinking MQA does no harm to me as long they don't use Tidal.
GoldenOne is the person who created the video linked above also hinted to another problem: MQA flagging removed
This means there may be MQA processed files out there simply not being identifiable as such.
In this process the lower bits are pure and hard to compress garbage. It reduces the available bits you purchase.
Labels may prepare one and the same data but only flag the files used for explicit MQA certified enviroments.
For 16bit MQA butchered CD files you may loose up to 3 bits if i understood this right.

He said that the 2 files were bit-identical, but one identified as MQA and the other didn't. Since the MQA control bitstream is embedded in the audio, both claims can't be correct?

No idea where the MQA is exactly embedded but it doesn't seem so easy. There is mqascan and MQA identifier for detecting it but MQA identifier seems to miss some files where mqascan does detect it.
Maybe you can find a post Mans Rullgard the mqascan dev describes its working.

Mans handed me the clue I was missing... Apparently Tidal indicate whether a file is MQA or not in the metadata. But both files actually contain MQA encoded audio. Shady AF...

Now to the next disturbing thing one can learn from following the different active MQA threads here and there.
The Roon music software pays money to MQA for every decode they do in their player.
At Audiophile Style someone linked to the Roon forum post of a COO posting "MQA bills us based on Core Decodes"
This MQA vermin is a clever beast indeed. Wonder how much money the artist sees for every Core Decode.
Oh Wait! The artist already has the MQA encrypted Crown Jewels rescued so this is obviously only fair...

That can't possibly be true, surely!? Who the hell would sign up to that business model? Maybe that's why Roon is charging soft heads $700 for a software media player...
