Bitrate is lower than what was set

I am using Easy CD-DA Extractor 8.2.2 and Yahoo Music Engine 1.0.2.138.

I am ripping music CDs into .m4a (MPEG-4/AAC format). 

I am setting the bitrate to be 128 or 160 or 192 CBR.

On replay in iTunes, WinAmp, etc, the bitrate comes out to be 127 or 158 or 190.  I can't seem to get the constant bitrate I am setting.

What might be causing the bitrate to be one or two numbers lower than what was set?

My guess: the encoding engine is being specified the bitrate, but not being told that it's encoding to the MP4/M4A container instead of AAC (ADTS) files. Since MP4/M4A has an overhead that is slightly lower, the actual file ends up being off by this amount.

The files are still CBR, though.
