CBR mp3 but with VBR info

Hi!
I found an mp3 which is 320kbps CBR stereo (has ID3v1 and ID3v2), but:

foobar reports:

Vbrfix reports that it's not VBR.

Is there anything I can do to fix this?

Hmmm, checking "write even if not vbr" in vbrfix, does fix it, but the resulting mp3 has less samples. Could this be a problem?

hm that's weird, no lame header...
download the trial version of mp3trim and let it repair the file by opening it and saving it right after (enable the various auto-cleanup switches first).

Thanks sony666, mp3trim cleaned it after i unchecked "keep vbr seek or extra info header if present", just like vbrfix did, but the number of samples stayed the same as the original (unlike vbrfix). 
IIRC, the lame header was not present in v3.89 beta, am i right?

I didn't use mp3trim for quite a while, but from time to time it's a very handy tool for badly messed up files.
